The third school of modern negotiation gets written about least and matters, perhaps, most. It is the cognitive-bias school, built primarily at Harvard Business School by Max Bazerman and Deepak Malhotra and laid out in their book Negotiation Genius. Where Fisher and Ury argue about how negotiations should be structured, and Voss argues about how the emotional layer should be handled, Bazerman and Malhotra ask a different question: how do negotiators actually think? The answer, as Daniel Kahneman taught a generation of economists, is: not as rationally as they believe they do.
Anchoring is the first of the biases. The number named first in a negotiation — even when both sides know it's a first move — exerts a gravitational pull on the final outcome. In Kahneman and Tversky's experiments, the anchor doesn't have to be plausible; it just has to be there. In real negotiations, the side that names a number first usually does better. Bazerman and Malhotra's advice is mechanical: name your number first when you have the information to do so, and when the other side anchors you, do not counter-anchor — re-anchor entirely, in a separate move, with reference to your own data.
Framing is the second. The same proposal, described two different ways, produces two different decisions. You'll save twenty per cent on this contract is processed differently from you'll pay eighty per cent of the listed rate. People are loss-averse — they feel losses about twice as strongly as equivalent gains — and a negotiator who understands framing knows that presenting their proposal in gain language and the alternative in loss language is a structural advantage. Recognising when your counterpart is doing this to you, and re-framing in your own language before responding, is the defensive version of the same move.
The contrast effect is the third. Whatever was on the table immediately before yours sets the comparison context for how yours is received. A house priced at €600,000 feels reasonable after viewing two others at €750,000, even if the absolute value would be high in isolation. Skilled negotiators sometimes lead with a deliberately unattractive option to make their preferred one look better by contrast. The defence: notice the contrast, and evaluate against absolute standards rather than relative ones.
Loss aversion deserves its own treatment. Identified by Kahneman and Tversky in the 1970s and replicated in hundreds of studies since, the asymmetry has specific consequences in negotiation. Concessions, once made, feel disproportionately costly. Sunk costs feel disproportionately important. Walking away from a deal that has been worked on for weeks feels harder than declining the same deal in week one. Bazerman and Malhotra's prescription is to name your loss aversion to yourself in real time, and ask whether the deal you are about to accept is actually one you would have started from in week one.
There are more — the winner's curse, the fixed-pie assumption, reactive devaluation, overconfidence in your own judgment. Each is documented in controlled experiments. None is easy to overcome by willpower alone. The point of the cognitive school is not to rid yourself of the biases — Bazerman and Malhotra are clear this is impossible — but to know which you are most prone to, build small structural defences (write your reservation price down before the meeting; sleep on any decision made under time pressure), and recognise when the other side is exploiting one of yours.
This is the most quietly useful of the three schools and the least often read. Voss is a bestseller because he wrote a narrative book. Fisher and Ury are a business-school staple. Bazerman and Malhotra wrote a slower, more careful book that asks the reader to sit with experimental evidence. The reward is the rare experience of catching yourself, mid-negotiation, doing the thing the research said you would do — and stopping. That moment is what skilled negotiators describe when they describe what they actually do.
